How brokerage representation works

Representing a buyer or tenant

A broker may agree to represent a buyer or tenant and must place that client’s interests above the broker’s own while providing honest, informed guidance.

Representing an owner or landlord

A broker may agree to represent a seller or landlord in marketing, negotiations, disclosures, and the other services established in the representation agreement.

Intermediary relationships

With written consent, a broker may act as an intermediary when clients represented by the same broker are on opposing sides of a transaction. The required notices and limitations apply.

Minimum duties

A Texas broker representing a client must perform the minimum duties required by law, including presenting offers and counteroffers and answering the client’s questions.

Official prescribed notice: Texas requires the completed current TREC Information About Brokerage Services form to be available through the brokerage website. The verified company and designated-broker information above is prepared for that form. A public broker email required by the prescribed form has not been provided, so the website does not invent one.

Once the required broker email is supplied and the official form is completed, its PDF will be linked directly from the homepage in place of this interim disclosure page.
